This privacy policy sets out how PCI-PAL PLC uses and protects any information that you give PCI Pal when you use this website.

PCI Pal is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement.

PCI Pal may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from 25-05-2018.

WHAT WE COLLECT

WHAT WE DO WITH THE INFORMATION WE GATHER

PRIVACY SHIELD COMPLIANCE

We comply with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and the United Kingdom to the United States.

We have certified to the Department of Commerce that we adhere to the Privacy Shield Principles. If there is any conflict between the terms in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Our participation in the Privacy Shield applies to all Personal Information that is received from the European Union, European Economic Area, and the United Kingdom. We will comply with the Privacy Shield Principles in respect of such Personal Information.

We remain individually responsible and liable under the Privacy Shield Principles if third-party agents that we engage to process the Personal Information on our behalf do so in a manner inconsistent with the Principles, unless PCI Pal, as applicable, proves that it is not responsible for the event giving rise to the damage. Except as required by applicable law, PCI Pal provides consumers with an opportunity to opt out of sharing their personal data with third parties or further processing of their personal information for different purposes than those initially agreed. PCI Pal requires all third-party data recipients to contractually agree to provide the same level of protection for personal data as is required of PCI Pal by the Privacy Shield Principles. PCI Pal may be required by law to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements..

We may share your personal data with our contractors and service providers who process personal data on behalf of PCI Pal (U.S.) Inc., to perform certain business-related functions. These companies include cloud infrastructure providers, database service providers, backup and disaster recovery service providers, email service providers and others. When we engage another company to perform such functions, we may provide them with information, including personal data, in connection with their performance of such functions.

If we have received your personal data in the United States and subsequently transfer that information to a third party agent or service provider for processing, we remain responsible for ensuring that such third party agent or service provider processes your personal data to the standard required by our Privacy Shield commitments.

Personal information may be shared with third parties for the various purposes as follows:

(a) Anonymized information. If we anonymize personal data, we may share that personal data with anyone for any purpose.

(b) Persons with whom we do business. We may provide personal data to others involved in the provision or receipt of goods and/or services so that we can cooperate in providing or receiving goods and/or services.

(c) Outsourcing providers. We may provide personal data to outsourcing providers who perform functions in support of our conduct of business. This might include data processing, storage, system administration, and similar functions.

(d) Successors. If we sell or otherwise transfer all or a part of our business, or are investigating the possibility of doing so, we may transfer to, or share with, the actual or potential buyer or other transferee, the personal data associated with the actually or potentially sold or transferred business.

(e) To comply with legal requirements. Under certain circumstances, we may be required to disclose your personal information if required by law enforcement, government agencies, courts, or others where we believe that our cooperation with information requests is required by law.

If you wish to access the personal information we hold on you or if you believe we have not adhered to this privacy policy, you may contact us at any time (see ‘Controlling your personal information’ below). If you feel that your complaint has been addressed incompletely, we invite you to let us know for further investigation. For complaints left unresolved by all other available mechanisms, PCI Pal has further committed to cooperate with the panel established by the EU and UK data protection authorities (DPAs) with regard to unresolved Privacy Shield complaints concerning personal data transferred from the EU or UK, especially human resources data transferred from the EU or UK in the context of the employment relationship.

The EU and UK DPAs serve as an appropriate independent recourse mechanism/s (IRMs) for dispute resolution. PCI Pal is registered with the United States Council for International Business (USCIB) to provide access to the EU and UK DPAs’ dispute resolution panel.

Under certain circumstances, you may invoke binding arbitration for complaints regarding Privacy Shield compliance when other dispute resolution procedures have been exhausted.

Company is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission (FTC) with respect to your privacy rights.

CHILD WEBSITE USERS

As the products and services we offer are aimed at companies, this website is designed and intended for use only by adults. We do not knowingly collect and process information from children (anyone of or under the age of 13).

If you are under the age of 13, we ask that you do not give us any information about you or use our websites. If you are aged between 13 and 18, we request that you seek your parent or guardian’s permission before providing us with your information or using our website.

If you are a parent or guardian of a child under 13 and you think that your child has used our website or elsewise provided their information to us without your consent, please contact us (see ‘Controlling your personal information’ below) and we will delete and/or stop processing your child’s personal information within a reasonable time.

Controlling your personal information

You may choose to restrict the collection or use of your personal information in the following ways:

  • Your information will only be used by anybody for direct marketing purposes if you have ticked the box to indicate that you want to be contacted for these purposes.
  • You may contact us to request a copy of the information we hold on you, the correction of invalid data about you, the erasure of data we hold about you, the restriction of any further processing of that data, for us to transfer the data we hold about you to another organisation, or to object about our processing of your data.

The above data subject rights requests are handled free of charge, within reason. We will respond to any data subject rights requests within a month, to confirm your request has been completed, to explain why we could not action your request, or to notify you of any delays in actioning your request.

If we do not action your request, delay action on your request for more than two months after the initial one-month deadline, or elsewise fail in our responsibilities as a Data Controller, you are able to lodge a complaint with the ICO (or your own national supervisory authority on data protection) or seek judicial remedy. If we are unable to identify your record (or entertain reasonable doubts about your identity), we may request provision of some additional information necessary to confirm your identity prior to actioning your request.

We encourage you to discover your rights and our responsibilities under the EU Regulation 2016/679 (General Data Protection Regulation), as well as any subsequent or supplementary legislation.
