As the products and services we offer are aimed at companies, this website is designed and intended for use only by adults. We do not knowingly collect and process information from children (anyone of or under the age of 13).

Data Privacy Framework Compliance

We comply with the EU-U.S. Data Privacy Framework program (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union (and European Economic Area) and the United Kingdom to the United States.
We have certified to the Department of Commerce that we adhere to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles). If there is any conflict between the terms in this Privacy Policy and the EU-U.S. Data Privacy Framework Principles, the EU-U.S. Data Privacy Framework Principles shall govern. Our participation in the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF applies to all Personal Information that is received from the European Union, European Economic Area, and the United Kingdom. We will comply with the EU-U.S. DPF Principles in respect of such Personal Information.

We remain individually responsible and liable under the EU-U.S. DPF Principles if third-party agents that we engage to process the Personal Information on our behalf do so in a manner inconsistent with the EU-U.S. DPF Principles, unless PCI Pal, as applicable, proves that it is not responsible for the event giving rise to the damage. Except as required by applicable law, PCI Pal provides consumers with an opportunity to opt out of sharing their personal data with third parties or further processing of their personal information for different purposes than those initially agreed. PCI Pal requires all third-party data recipients to contractually agree to provide the same level of protection for personal data as is required of PCI Pal by the EU-U.S. DPF Principles. PCI Pal may be required by law to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

We may share your personal data with our contractors and service providers who process personal data on behalf of PCI Pal (U.S.) Inc., to perform certain business-related functions. These companies include cloud infrastructure providers, database service providers, backup and disaster recovery service providers, email service providers and others. When we engage another company to perform such functions, we may provide them with information, including personal data, in connection with their performance of such functions.

If we have received your personal data in the United States and subsequently transfer that information to a third party agent or service provider for processing, we remain responsible for ensuring that such third party agent or service provider processes your personal data to the standard required by our EU-U.S. DPF commitments.

EU and UK (including Gibraltar) data subjects have the right to access personal data maintained about them and to impose certain limits on the use and disclosure of such personal data. PCI Pal has committed to uphold these EU-U.S. DPF Principles, but our ability to access certain personal data of individuals directly may be restricted depending on our services.

If you wish to access the personal data we hold on you or if you believe we have not adhered to this privacy policy, you may contact us at any time (see ‘Contact Us’ below). If you feel that your complaint has been addressed incompletely, we invite you to let us know for further investigation. For complaints left unresolved by all other available mechanisms, PCI Pal has further committed to cooperate with the panel established by the EU and UK data protection authorities (DPAs) with regard to unresolved EU-U.S. DPF complaints concerning personal data transferred from the EU or UK, especially human resources data transferred from the EU or UK in the context of the employment relationship.

The EU and UK DPAs serve as an appropriate independent recourse mechanism/s (IRMs) for dispute resolution. PCI Pal is registered with the United States Council for International Business (USCIB) to provide access to the EU and UK DPAs’ dispute resolution panel.

PCI Pal is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission (FTC) with respect to your privacy rights.

CALIFORNIA USERS: CALIFORNIA SHINE THE LIGHT LAW

If you are a California resident, you have the right to request information from us regarding the manner in which we share certain categories of personal information with third parties for their direct marketing purposes, in addition to the rights set forth above. Under California law, you have the right to send us a request to our Data Protection Officer at the designated address listed below to receive the following information:

The categories of information we disclosed to third parties for their direct marketing purposes during the preceding calendar year;
The names and addresses of the third parties that received the information; and
If the nature of the third party’s business cannot be determined from their name, examples of the products or services marketed.

Your GDPR Rights

Where we process Personal Information pertaining to individual located in the European Economic Area (“EEA”) or the UK, those individuals are entitled to ask us for an overview of the Personal Information we have about them and also to access, correct or delete certain Personal Information, restrict processing of their Personal Information, or to ask us to transfer Personal Information to other organizations. Certain individuals can also object to some processing of their Personal Information and, where we have asked for their consent, they can withdraw their consent at any time. Insofar as Personal Information about them is processed, certain individuals also have a right to know more about the protection we apply when transferring Personal Information to areas outside the EEA or the UK.

Note that we are not legally obligated to agree to such requests in all circumstances, and in certain circumstances, agreeing to a request may be infeasible – for example, a deletion request when we are required by law to maintain the Personal Information. Please also note that we are not able to act on any of the above requests if we are not in a position to identify an individual filing such request.

The above data subject rights requests are handled free of charge, within reason. We will respond to any data subject rights requests within a month, to confirm your request has been completed, to explain why we could not action your request, or to notify you of any delays in actioning your request.

If we fail in our responsibilities as a Data Controller, you are able to lodge a complaint with the ICO (or your own national supervisory authority on data protection) or seek judicial remedy. If we are unable to identify your record (or entertain reasonable doubts about your identity), we may request provision of some additional information necessary to confirm your identity prior to actioning your request.
